(Ocala, Florida, January 17, 2025). Yesterday, Judge James Moody of the U.S. District Court for the Middle District of Florida in a case styled, Loomer vs. Maher, et. al, 24-CV-00625 (M.D. Fl.), denied a motion to dismiss filed by Hollywood political pundit Bill Maher and the broadcast network, HBO, for his weekly show "Real Time with Bill Maher."

Maher is alleged to have defamed Laura Loomer, by publishing:

I think maybe Laura Loomer's in an arranged relationship to affect the election because she's very close to Trump. She's 31, looks like his type. We did an editorial here a few years ago…it was basically, who's Trump fucking? Because I said, you know, it's not nobody. He's been a dog for too long, and it's not Melania. I think we may have our answer this week. I think it might be Laura Loomer.

This alleged defamation, which falsely implicates Ms. Loomer in "fucking" and thus committing adultery with President Trump behind the back of First Lady Melania Trump, was found to have been properly plead as defamation per se in Ms. Loomer's complaint, which seeks damages in excess of $150 Million Dollars.

Defamation per se is the strongest form of defamation, as it implicates immoral behavior. Should the jury ultimately find defamation per se, actual malice and damages are presumed and only the amount of damages need be put forth by a plaintiff such as Ms. Loomer.

Specifically the Court ruled as follows:

Defendants' Motion to Dismiss (Dkt. [17]) is denied in part and granted in part. Plaintiff's defamation per se claims are properly pled and will not be dismissed. This moots Defendants' argument that the Complaint violates Florida's anti-SLAPP statute.

In denying Maher's and HBO's motion to dismiss, the Court also thus shot down their threat to seek attorneys fees under Florida's Anti-SLAPP statute, and ordered that discovery proceed. In this regard, Maher and HBO will now have to produce documents and sit for depositions, all of which will uncover the full extent of their actual malice against not just Ms. Loomer, but also President Trump and First Lady Melania Trump. Maher is known to be a vicious Trump hater, and Maher used his hatred of President Trump to attack Ms. Loomer with lies that were used as a vehicle to harm President Trump in the lead up to the 2024 presidential election with accusations of adultery, which also severely harmed Ms. Loomer.

Bill Maher and HBO will be taught a lesson that they cannot say anything they please to boost ratings to harm an innocent woman who supports President Trump. Their arrogance and hatred of anyone who supports President Trump will ultimately cost them dearly before a Florida jury of their peers. During my tenure as the founder of Judicial Watch, ironically, I frequently appeared on Maher's then show "Politically Incorrect", and never saw this type of depraved behavior leveled against persons such as Ms. Loomer.  Over the years, Maher has become self-absorbed, arrogant, toxic, mean and unhinged – particularly whenever President Trump is involved in any way! His ‘Trump Derangement' and his attacks on my client Ms. Loomer will be his undoing.
